Terms and Conditions of Use VizorFin
VizorFin (hereinafter “VizorFin,” “we,” “us,” or “our”) provides an artificial intelligence platform for financial analysis through its website https://www.vizorfin.com and related interfaces (the “Platform”). By registering, accessing, or using the Platform, you (the “User” or “you”) agree to comply with these Terms and Conditions of Use (the “Terms”). Please read them carefully before using our services.
If you do not agree with any part of these Terms, you may not access or use our services.
At VizorFin, we are committed to transparency and the protection of your rights. These Terms are designed to comply with applicable regulations in Chile (Law No. 21.096 on Personal Data Protection, Law No. 19.496 on Consumer Rights Protection) and in Venezuela (Data Messages and Electronic Signatures Law, Consumer and User Protection Law).

2. Key Definitions
To ensure a correct interpretation of these Terms, we define the following concepts:
- Platform: The software-as-a-service (SaaS) artificial intelligence solution known as VizorFin, accessible through https://www.vizorfin.com and its related interfaces (API).
- AI Agents: The various artificial intelligence modules that make up VizorFin, including but not limited to the Reconciliation, Fraud Detection, Credit Analysis, Tax Optimization, Collections Management, Cash Flow Projection, Audit, Risks, Market Intelligence, Data Fusion, and RegTech agents.
- User Content: All documents, files (CSV, Excel), texts, prompts (inputs) that the User uploads to the Platform, as well as the responses and analyses generated by the AI Agents.
- Financial Data: Any information relating to bank transactions, invoices, account statements, tax payments, credit histories, and any other economic information that the User provides to the Platform.
- Subscription Plans: The different levels of access and usage of the Platform (Free, Pro, Business, Enterprise) as described on our Plans and Pricing page, which form an integral part of these Terms and Conditions.
3. Acceptance and Modification of Terms
3.1. By registering, accessing, or using the Services, the User declares that they have read, understood, and accepted all of these Terms and Conditions, as well as our Privacy Policy, which are incorporated by reference.
3.2. VizorFin reserves the right to modify these Terms at any time. Modifications will become effective immediately upon posting on this page. Users will be notified at least 15 days in advance of substantial changes via email or a prominent notice on the Platform.
3.3. It is recommended to review this page periodically to stay informed of any changes. Continued use of the Platform after the publication of modified Terms will constitute acceptance of such changes.
4. Registration, Account, and Security
4.1. To access the services, the User must register by providing truthful, accurate, and complete information, including name, email address, and, where applicable, billing details. Registration of minors under 18 years of age is prohibited.
4.2. The User is solely responsible for maintaining the confidentiality of their access credentials (username and password). Any activity conducted from their account will be attributed to them.
4.3. The User agrees to promptly notify VizorFin of any unauthorized use of their account or any other security breach via info@vizorfin.com.
4.4. VizorFin reserves the right to suspend or cancel inactive accounts for a period exceeding 12 months, upon prior notice to the User.
5. Subscription Plans and Billing
5.1. VizorFin offers different subscription plans (Free, Pro, Business, Enterprise), the features, usage limits, and prices of which are detailed on our Plans and Pricing page. Users on the free plan will only have access to the AI Agents included in that plan.
5.2. Payments will be processed through our authorized payment gateways (Stripe, PayPal). The User authorizes VizorFin to charge the amount corresponding to the selected plan on a recurring basis (monthly or annually) until the subscription is cancelled.
5.3. Subscriptions will automatically renew at the end of each period (monthly or annual) unless the User cancels their subscription at least 7 days in advance. The User may cancel their subscription at any time from their account dashboard.
5.4. Fees may change with 30 days prior notice. Fee changes will not affect the User’s current subscription period.
5.5. VizorFin offers a 14-day money-back guarantee for new subscribers. To request a refund, the User must contact info@vizorfin.com within the first 14 days following the subscription.
5.6. All payments are subject to applicable taxes (VAT, digital VAT, etc.), which will be added to the total amount when applicable according to the legislation of the User’s country.
6. AI Agents Service
6.1. VizorFin grants the User a limited, non-exclusive, non-transferable, and revocable license to access and use the AI Agents included in the contracted plan, exclusively for their internal commercial or professional purposes.
6.2. Description of AI Services:
- Financial Reconciliation: Compares payment and control files to detect discrepancies, incorrect amounts, and undocumented fees.
- Fraud Detection: Analyzes transactions to identify duplicates, unusual amounts, velocity patterns, suspicious hours, and money laundering.
- Credit Analysis: Evaluates creditworthiness by generating a 0-100 score, category, and recommended credit limit.
- Tax Optimization: Detects tax credits (creditable VAT) and unapplied ISLR deductions.
- Collections Management: Analyzes accounts receivable, debt aging, and generates personalized collection strategies.
- Cash Flow Projection: Predicts income and expenses using statistical models (Holt-Winters) and/or LSTM (Machine Learning).
- Automated Audit: Detects duplicates, atypical amounts, policy violations, and discrepancies with invoices.
- Risk Management: Comprehensively evaluates credit, liquidity, market, and operational risks.
- Market Intelligence: Calculates revenue, expenses, margins, seasonality, and customer/supplier concentration.
- Data Fusion: Recognizes and reconciles transactions between two sources (e.g., Plaid vs. ERP).
- RegTech: Verifies transactions against sanctions lists (OFAC, UN) and detects AML patterns.
6.3. Limitations of the AI Service: VizorFin is a technological assistance tool that processes data and generates analyses, but it does not constitute financial, legal, tax, accounting, or regulatory advice. The User acknowledges and agrees that:
- AI is probabilistic in nature and may generate errors, inaccuracies, hallucinations, or inconsistent results. The same inputs may produce different outputs. Results may be incorrect or misleading even when the system operates as designed.
- It is the User’s sole responsibility, in their capacity as a professional or businessperson, to review, verify, and validate any result generated by the Platform before using it for financial decision-making, presentations to authorities, or advice to third parties.
- AI-generated analyses should be considered as a starting point or input, not as a replacement for professional human judgment.
- VizorFin shall not be liable for any losses, damages, or harm arising from reliance on the analyses generated by its AI Agents, to the maximum extent permitted by applicable law.
6.4. AI Transparency: VizorFin uses artificial intelligence models, including language models and machine learning, provided by third parties to enhance the efficiency of its processes. Users will be informed when interacting with AI functionalities.
7. Connections to Banking Services
7.1. VizorFin offers the functionality to connect bank accounts through authorized service providers such as Belvo, Plaid, and Prometeo. By using this functionality, the User authorizes VizorFin and such providers to access their banking data.
7.2. The connection process with banking entities is carried out through widgets provided by such providers. Banking credentials are not stored by VizorFin at any time.
7.3. VizorFin shall not be liable for interruptions, errors, or unavailability of Belvo, Plaid, or Prometeo services, nor for the use that such third parties make of the User’s banking data in accordance with their own privacy policies.
8. Intellectual Property
8.1. VizorFin owns all intellectual property rights over the Platform, including its source code, design, algorithms, AI models, documentation, trademarks, logos, and trade names. The User does not acquire any ownership rights over the Platform, but rather a limited license of use.
8.2. The User retains ownership of all data, files, and content uploaded to the Platform (User Content). VizorFin does not claim ownership over such content.
8.3. The User grants VizorFin a worldwide, non-exclusive, royalty-free license to use, process, store, and transmit the User Content solely for the purpose of providing the contracted Services.
8.4. VizorFin reserves the right to use anonymized and aggregated data (which does not identify the User) to train and improve its AI models and algorithms. If the User does not wish their information to be used for these purposes, they may request it in writing to info@vizorfin.com.
9. Processing of Personal and Financial Data
9.1. The processing of personal data is governed by our Privacy Policy, which forms an integral part of these Terms and Conditions.
9.2. VizorFin acts as a Data Processor with respect to the personal data that the User (as Data Controller) provides to it. The User guarantees that they have the necessary legal basis for the processing of such data.
9.3. Financial Data will be treated with high security standards. VizorFin implements appropriate technical and organizational measures to protect the data, including TLS/SSL encryption in transit and encryption at rest.
9.4. Financial Data will be retained according to the periods established in our Privacy Policy and in accordance with applicable legal obligations.
10. User Obligations and Prohibited Uses
10.1. The User agrees to use the Platform in accordance with the law, morality, public order, and these Terms and Conditions. Specifically, the User may not:
- Upload files or content that are illegal, defamatory, obscene, abusive, invasive of privacy, infringing on intellectual property rights, or containing computer viruses.
- Attempt to circumvent security measures, access unauthorized restricted areas, or carry out brute force attacks.
- Use the Platform to carry out fraudulent activities, money laundering, terrorist financing, or any other illegal activity.
- Use the results or analyses generated by the AI Agents for automated decision-making in sensitive areas without proper human oversight.
- Use the Platform to train competing AI models or systematically extract its components to replicate them.
- Make an excessive number of requests that overload the Platform’s infrastructure.
- Impersonate another person or entity.
10.2. The User is responsible for the behavior of all authorized users under their account and for ensuring that such users comply with these Terms.
11. Service Availability and Support
11.1. VizorFin strives to maintain the Platform continuously available, but does not guarantee uninterrupted or error-free operation. The Service may be affected by scheduled maintenance (with at least 24 hours notice) or causes beyond our control (internet failures, cyberattacks, issues with cloud providers or AI providers).
11.2. VizorFin shall not be liable for data loss, damages, or harm arising from the unavailability of the Service, including those caused by failures of cloud service providers, internet connectivity, or AI providers.
11.3. Users on Pro and Business plans have email support. Users on Business plans additionally have priority support. Enterprise users have 24/7 support via phone and dedicated channel.
11.4. Support response times are indicative: Pro (48 hours), Business (24 hours), Enterprise (4 hours).
12. Data Retention and Deletion
12.1. Upon the end of the subscription period, the User will have a period of 30 days to export their data (reports, history). After this period, VizorFin may proceed with the irreversible deletion of such data.
12.2. Billing and payment information will be retained in accordance with legal tax obligations (generally 5-7 years depending on the jurisdiction).
12.3. Anonymous fraud patterns may be retained permanently to improve the system, provided they do not contain identifiable User information.
13. Suspension and Cancellation
13.1. VizorFin may suspend the User’s access to the Platform if:
- The User materially breaches these Terms and Conditions.
- There is a well-founded suspicion that the User is using the Platform for fraudulent or illegal activities.
- VizorFin is required to do so by order of a judicial or regulatory authority.
13.2. The suspension will be notified to the User whenever legally possible. The User may remedy the causes of suspension within 10 days following notification.
13.3. The User may cancel their subscription at any time from their account dashboard. Cancellation will be effective at the end of the current billing period, unless specified otherwise.
13.4. VizorFin reserves the right to suspend or cancel inactive accounts for a period exceeding 12 months, upon prior notice to the User.
14. Disclaimer and Limitation of Liability
14.1. The Platform is provided “AS IS” and “AS AVAILABLE”. VizorFin makes no warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, or non-infringement.
14.2. VizorFin does not warrant that the Platform will be uninterrupted, secure, error-free, or virus-free, or that the results obtained from the use of the Platform will be accurate, reliable, or correct.
14.3. AI may generate errors, inaccuracies, hallucinations, or inconsistent results. The User agrees that it is their responsibility to review, verify, and validate any output generated by the AI Agents before relying on it or using it for decision-making, as established in section 6.3.
14.4. To the maximum extent permitted by applicable law, VizorFin shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, business interruption, reputational harm, or loss of anticipated savings, arising from the use or inability to use the Platform.
14.5. VizorFin’s total liability under these Terms shall be limited to the amount of fees paid by the User during the 6 months prior to the event giving rise to the claim. For Users on the free plan, liability shall be limited to $50 USD.
14.6. The exclusions and limitations of liability set forth in this clause shall apply even if the law does not permit them and the limited remedy does not fulfill its essential purpose. Nothing in these Terms excludes or limits VizorFin’s liability for fraud, deceit, personal injury caused by negligence, or any other liability that cannot be excluded or limited by law.
15. Indemnification
The User agrees to indemnify, defend, and hold harmless VizorFin, its directors, employees, agents, and service providers from any claim, demand, loss, damage, cost, or expense (including reasonable attorneys’ fees) arising from:
- The User’s breach of these Terms and Conditions.
- The User’s misuse of the Platform.
- The User’s violation of any law or third-party rights.
- User Content uploaded to the Platform.
16. Dispute Resolution and Applicable Law
16.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Chile, without regard to its conflict of law principles.
For Users in Chile: The applicable legislation shall be Law No. 19.496 on Consumer Rights Protection and Law No. 21.096 on Personal Data Protection. Any dispute arising from these Terms shall be resolved before the ordinary courts of justice of the city of Santiago, Chile.
For Users in Venezuela: The applicable legislation shall be the Data Messages and Electronic Signatures Law and the Consumer and User Protection Law. Any dispute arising from these Terms shall be resolved before the ordinary courts of the city of Caracas.
16.2. For international Users outside Chile and Venezuela, the applicable law shall be that of the Republic of Chile, and the jurisdiction shall be the courts of Santiago.
16.3. Before initiating any legal action, the parties agree to attempt to resolve the dispute in good faith through direct negotiations for a period of 30 days.
16.4. If the dispute is not resolved through negotiation, the parties may submit it to a mediation process before a recognized mediation center. If mediation is unsuccessful, the dispute shall be resolved through arbitration in accordance with the Arbitration Rules of the corresponding Chamber of Commerce, in the event that the Commercial Arbitration Law in Venezuela or the arbitration law of Chile applies.
17. General Provisions
17.1. If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
17.2. VizorFin’s failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
17.3. These Terms constitute the entire agreement between VizorFin and the User regarding the Platform and supersede any prior agreements.
17.4. These Terms do not create a partnership, agency, franchise, or employment relationship between the parties.
17.5. The User may not assign or transfer these Terms without VizorFin’s prior written consent. VizorFin may assign these Terms without restriction.
